Terms of Service for Roadworks Radar

1. Who we are

Roadworks Radar (the “Service”) helps users monitor live and upcoming roadworks along their saved routes and areas. Our website is https://roadworksradar.uk (the “Site”). “We”, “us” and “our” refer to the Roadworks Radar service operated by the owner of this Site.

2. What these terms cover

These Terms and Conditions (“Terms”) govern your access to and use of the Site and the Service. By creating an account or using the Service, you agree to be bound by these Terms.

3. Accounts and eligibility

• You must be at least 16 to use the Service.
• You are responsible for all activity on your account and for keeping your sign‑in method secure (including magic links delivered to your email).
• We may suspend or terminate accounts that breach these Terms.

4. Subscriptions, billing and cancellation

• Paid access is provided on a subscription basis (e.g., annual), billed via our payment provider (currently Stripe). By starting a subscription you authorise recurring charges until you cancel.
• Prices, features and plans may change from time to time; changes will apply to new terms at renewal.
• You can cancel at any time; your access will continue until the end of the current billing period. We may issue refunds at our discretion where required by law.

5. What you get (and key limitations)

• Route monitoring: we surface live and upcoming roadworks that match your saved routes/areas using geospatial techniques (including H3 indexing and map data).
• Notifications/digests: we may send emails such as evening digests and account‑related emails (magic links, receipts). You can manage non‑essential digests in your dashboard.
• Data sources and accuracy: roadworks information is obtained from third‑party sources (including the UK Department for Transport and local authorities). While we aim to be timely and accurate, the Service depends on external feeds and geospatial processing and may contain errors, delays, omissions or gaps. You should not rely on the Service as the sole source for safety‑critical decisions while driving.

6. Acceptable use

You agree not to:
• misuse, scrape, copy or re‑distribute the Service or its data except as allowed by normal use;
• attempt to reverse‑engineer or circumvent security/usage limits;
• upload or transmit harmful code; or
• use the Service in a way that infringes others’ rights or violates applicable law.

7. Intellectual property

We (or our licensors) own all intellectual property in the Site and the Service, including compiled datasets, UI, and code. You may use the Service for your personal or internal business purpose. You may not resell, sublicense, or commercially re‑distribute our outputs without prior written consent.

8. Privacy

We process personal data in accordance with our Privacy Policy, available at https://roadworksradar.uk/privacy-policy. By using the Service you consent to such processing.

9. Availability and changes

We strive to keep the Service available, but we do not guarantee uninterrupted operation. We may modify, suspend, or discontinue parts of the Service (including specific features, plans, or pricing). If we discontinue a paid plan mid‑term, we will provide a pro‑rata refund where appropriate.

10. Disclaimers

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties (express or implied), including fitness for a particular purpose and non‑infringement. Roadworks Radar is an information tool and does not replace official road notices, signage, or your own judgement while driving.

11. Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, lost profits, loss of data, or business interruption, even if advised of the possibility. Our aggregate liability for all claims relating to the Service will not exceed the total fees you paid for the Service in the twelve (12) months preceding the claim (which, for the Annual plan, is currently £20). If you have not paid any fees, our aggregate liability will be £0.

12. Indemnity

You agree to indemnify and hold us harmless from any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or related to your misuse of the Service or breach of these Terms.

13. Third‑party services

The Service integrates with third‑party services (e.g., Stripe for payments, Resend for emails, mapping providers). Your use of those services may be subject to their own terms and privacy notices.

14. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction, except that consumers resident elsewhere in the UK or EU may benefit from mandatory consumer protections and bring claims in their local courts.

15. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will notify you (for example by email or in‑app). Your continued use of the Service after changes take effect means you accept the updated Terms.
